These Terms and Conditions (“Terms”) govern the use of the Kistp® Ebike, 450w Electric Scooter website (the “Site”) and any related services provided by Kistp® Ebike, 450w Electric Scooter (the “Services” ). The Site and Services are owned and operated by Kistp (“Kistp,” “we,” “us” or “our”).
Please read these Terms carefully before using the Site or Services. By accessing or using the Site or Services, you agree to be bound by these Terms and all policies and guidelines incorporated by reference. If you do not agree to all of these Terms, do not access or use the Site or Services.
Use of Site and Services
The Site and Services may be used only by individuals who can form legally binding contracts under applicable law. The Site and Services are not available to minors.
To use certain features of the Site or Services, you may be required to register with us, submit certain information about yourself and create a user name and password. You agree to provide true, accurate and complete registration information and to update your information to keep it accurate.

If you wish to purchase products on the Site, you will be asked to supply certain payment and credit card information. By submitting such information, you grant Kistp the right to provide the information to payment processing services in order to validate credit information and process payments.
All descriptions, images and references to products and prices on the Site are subject to change at any time without notice. Certain weights, measures and other descriptions are approximate and are for convenience only. We make reasonable efforts to accurately display the attributes of our products but the actual color you see may depend on your computer system and we cannot guarantee the products will look exactly as displayed on your device.
Product Availability and Quantities
Items in your Shopping Cart may sell out before you complete your order. We may limit quantities available for purchase. Published prices and available quantities are subject to change without notice.
Shipping and Delivery
When you purchase products from us, the products will be delivered through a third party shipping partner. We make reasonable efforts to deliver products in a timely manner, but we are not responsible for shipping delays or problems caused by our shipping partners.
Returns and Refunds
Items purchased from Kistp may be returned and refunded within 30 days of the original purchase date in new and unused condition. Customized items are nonrefundable. Shipping charges are nonrefundable.
To request a return, please contact us and provide your order information. You will be given instructions on how to properly return the product.
Only regular priced items may be refunded. Unfortunately sale items cannot be refunded. Items must be returned in new and unused condition with the original tags and labels still attached. Items that appear used, damaged, or are missing tags cannot be refunded.
Prohibited Conduct
You agree not to:
- Use the Site or Services for any illegal purpose or in violation of any local, state, national or international laws;
- Violate or encourage others to violate any right of or obligation owed to a third party;
- Post or transmit any unlawful, threatening, abusive, libelous, hateful, obscene, vulgar, indecent, inflammatory, or profane material;
- Post or transmit any information, software or other material that contains a virus, trojan horse, worm or other harmful component;
- Post or transmit any information, software or other material that contains false or misleading indications of origin, endorsement or statements of fact;
- Restrict or inhibit any other user from using the Site or Services.
You are solely responsible and liable for all your activities using the Site or Services, including any content you contribute.
Content Ownership
Kistp alone retains all right, title and interest, including intellectual property rights, in the Site, Services and all content, features, technologies or functionality provided by Kistp. This includes any Kistp trademarks, service marks, graphics, logos, button icons, scripts, source code, content, text, videos, etc.
You may not copy, modify, distribute, sell, lease, loan or derive any monetary benefit from any Kistp content, features or functionality without written permission.
User Content
You may be able to post user content on the Site, including comments, reviews, photos and videos. By posting any user content, you represent that you own the rights to such content and grant Kistp a perpetual, worldwide, non-exclusive, royalty-free, irrevocable right and license to use, edit, modify, reproduce, distribute and create derivative works from such content.
Kistp has no obligation to monitor, approve or remove any user content. However we reserve the right to delete or modify any user content at any time and for any reason without notice. User content does not represent Kistp’s views and is not endorsed by Kistp.
Indemnification
You agree to defend, indemnify and hold harmless Kistp and its directors, officers, managers, employees, agents, vendors, licensors and partners from and against any claims, actions or demands, liabilities and settlements arising out of or related to your use of the Site or Services, violation of these Terms, or violation of any rights of a third party.

THE SITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, KISTP EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
KISTP MAKES NO REPRESENTATIONS OR WARRANTIES THAT ACCESS TO THE SITE OR SERVICES, OR ANY OF THE MATERIALS CONTAINED THEREON, WILL BE CONTINUOUS, UNINTERRUPTED, SECURE, OR ERROR FREE. YOU ACKNOWLEDGE THAT YOUR ACCESS AND USE IS AT YOUR OWN RISK.
Limitation of Liability
UNDER NO CIRCUMSTANCES SHALL KISTP OR ITS DIRECTORS, OFFICERS, MANAGERS, EMPLOYEES, AGENTS, VENDORS, LICENSORS OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS OR USE OF THE SITE OR SERVICES.
Dispute Resolution
You agree that any dispute arising out of or relating to these Terms or your use of the Site or Services will be resolved solely through confidential binding arbitration before the American Arbitration Association utilizing its Consumer Arbitration Rules. The arbitration shall take place in your state of residence and judgment on the award may be entered in any court of competent jurisdiction. All proceedings shall be conducted in English. You agree to waive any right to participate in class action lawsuits against Kistp.
Governing Law
These Terms shall be governed by the laws of the State of Delaware without regard to conflict of law principles. Sole and exclusive jurisdiction for any action or proceeding arising out of or related to these Terms shall be the state or federal courts located in Delaware.
Termination
Kistp may restrict, suspend or terminate your access to the Site and Services if we believe you have breached these Terms. Sections regarding indemnification, disclaimers of warranties, limitations of liability and dispute resolution shall survive termination of these Terms.
Entire Agreement
These Terms constitute the entire agreement between you and Kistp relating to your access and use of the Site and Services. These Terms supersede any prior or contemporaneous representations or agreements. Amendments to these Terms may be made by Kistp as set forth in these Terms without notice to you and shall be effective immediately upon posting on the Site.
